Oregon put on probation, but faces no bowl ban

The NCAA stripped Oregon of a scholarship in each of the next three seasons and placed the program on probation for three years, opting against stiffer penalties like a bowl ban despite issuing a show-cause order against former coach Chip Kelly, who apologized to the school, its fans and it players.

The NCAA's Division I Committee on Infractions released a report on Wednesday that said Kelly failed to monitor the program for its improper involvement with Willie Lyles and his Houston-based recruiting service.

Kelly was hit with an 18-month show-cause order, a sanction that likely will have limited impact now that he's coaching the Philadelphia Eagles.

The program he left behind was stripped of scholarships, paid visits and evaluation days, but avoided some of the harsher penalties handed down to other programs in recent years.

"Now that the NCAA has concluded their investigation and penalized the University of Oregon and its football program, I want to apologize to the University of Oregon, all of its current and former players and their fans," Kelly said in a statement. "I accept my share of responsibility for the actions that led to the penalties. As I have I stated before, the NCAA investigation and subsequent ruling had no impact on my decision to leave Oregon for Philadelphia. I have also maintained throughout that I had every intention to cooperate with the NCAA's investigation, which I did."

The NCAA had been looking into Oregon's program for more than two years after learning Oregon had paid $25,000 to Lyles and his recruiting service, Complete Scouting Services.

The NCAA's infractions committee found that Lyles provided cash and free lodging to a prospect, and engaged in impermissible calls and off-campus contact with prospects, their families and high school coaches.

It also said the football program exceeded coaching limits by allowing staff members to engage in recruiting activity.

Oregon lost one scholarship in 2012-13 and will lose another during the next academic year through self-imposed sanctions. It also will have its total number of scholarships reduced by one from a maximum of 85 each of the next three seasons, also self-imposed.

The NCAA cut Oregon's official paid visits from 56 to 37 for the next three academic years, reduced its spring and fall evaluation days for each of the next three seasons and banned the program from using recruiting services during the probation period. Oregon must also disassociate itself from Lyles and his recruiting service.

The show-cause order for Kelly will require schools to go before the infractions committee should they wish to hire him, which seems unlikely since the coach just left for the NFL. Former Oregon assistant director of operations Josh Gibson was given a one-year show-cause order after the NCAA said he was aware of Lyles' involvement in recruiting and routinely told him to tell recruits to contact football coaches.

"Listen, no one wants to be in this position so I don't think anybody's happy," Oregon athletic director Rob Mullens said. "Again, we're pleased to be at the end of the process and we're ready to move forward. We've learned a lot, some mistakes were made and we corrected some of those along the way and we still have some more things to implement. But we're pleased that it's finished."

The NCAA had been looking into Oregon's recruiting practices since questions arose over a 2010 payment to Lyles. He had a connection with Lache Seastrunk, a star prep running back from Texas who committed to Oregon in 2010, a month before the payment.

When Oregon later released the recruiting package it said Lyles had prepared for the school, the material was largely outdated. While use of services to identify potential recruits is allowed under NCAA rules, questions were raised about Lyles' relationship with Seastrunk and other athletes from Texas, and whether he steered any prospects to the Ducks, which would be a violation.

Seastrunk redshirted for the Ducks his freshman year before transferring to Baylor prior to the 2011 season.

The NCAA said Kelly was unaware of Lyles' involvement in recruiting, but the committee noted it is the head coach's responsibility to know the rules and ensure staff and coaches comply with them.

"I've not met an institution that wants to go through the infractions and enforcement process," infractions committee member Greg Sankey said. "This was a multi-year effort that certainly existed and there are penalties that impacted the program. The committee made its decisions based on information given to it, not on other speculation and evaluations."

Under Kelly, the Ducks appeared in four straight BCS bowl games ? including a bid for the national championship against Auburn in 2011. Oregon finished 12-1 last season, capped by a victory over Kansas State in the Fiesta Bowl.

He was replaced by offensive coordinator Mark Helfrich, who will make his debut as head coach on Aug. 31.

Oregon was previously penalized by the NCAA in 2004 for a major violation involving the improper recruitment of a junior college player by an assistant coach. The university was put on probation for two years and the unidentified assistant coach was suspended without pay for a week and restricted from some recruiting activities.

The Ducks remained eligible for postseason play and did not lose any scholarships because of that violation, which occurred in 2003.

The latest recruiting violations are another hit to Oregon's image, but are unlikely to have an impact on the field for a program that's become an annual national-title contender

"It was a lengthy process," Mullens said. "We've been at this for two and a half years and as we said, there's been some negative recruiting around it. Obviously, the length of the process and the process itself had some punitive measures to it. In the end, I don't think the facts tarnish anything."

After their split, Kat Von D and Deadmau5 both took to their social media accounts to tell their sides of the story.

Kat Von D and Deadmau5's engagement started over Twitter, so it's only appropriate that they would discuss their break up on the social network site.

The couple, who have been engaged since December when the DJ sent a proposal to Von D via Twitter, have called it quits over allegations that he cheated.

Von D posted a cryptic tweet on Wednesday, and later followed it up with a second tweet that gave her more than 1 million Twitter followers a bit more detail on her current situation.

For his part, Deadmau5 (real name Joel Zimmerman) is denying he ever cheated, offering his Facebook fans and Twitter followers his own version of what went down:

At the end of June, it was clear that the relationship was not working and we mutually ended the engagement. I was not, at any point, unfaithful to Kat during our time together.

In the Facebook post, Deadmau5 admits that he did have "relations" with another woman before he proposed to Von D, but claims that it happened while he and the former reality personality were broken up.

Von D certainly hasn't been lucky in love. This is the third failed engagement for the tattoo artist in two years. She was previously engaged -- twice! -- to motorcycle builder and reality star Jesse James. Before that, she was married to fellow tattoo artist Oliver Peck from 2004 to 2007.

Poncho: The Best Weather Service You've Never Heard Of

The weather. It's all anyone talks about these days. But there's never been one single service that gets it right, or even bothers to tell you what you actually need to know. Well, Betaworks' Poncho, a new weather service, might have just figured it all out?with a simple text message in the morning.

With constant internet access and real-time data at our disposal, the simple act of checking the weather has gotten rather complicated, when all you need to know is whether or not you need a jacket and/or umbrella. Launched back in mid-April, Poncho is the brainchild of Kuan Huang, a resident hacker at Betaworks, who's looking to change just that.

"We're not a real-time weather service. Poncho is something you read in the morning to help you plan your day. We're trying to help optimize your routine," Huang recently told me.

If anyone can dream up a better system, it's Betaworks. These are the same folks who resuscitated Digg in just six weeks, created one of the most addictive iOS games in recent memory, and launched a new RSS reader this past week.

Ironically, Huang admits to never having checked the weather before joining Betaworks and starting Poncho. He says the most useful weather service was his mother who would alert him to any drastic shifts in temperature while he was in college. "I went to school in China and would study late in the library till 2 or 3 AM. She'd never tell me the exact temperature or wind speed, she'd just tell me the information I needed to know," Huang reminisces. That experience served as inspiration for Poncho's weather service, which is personalized and context-based.

When you sign up for Poncho?limited to New York City for now?you fill out a quick survey of your habits and routines, like what time you wake up or what train you take, and whether or not you have pets or allergies, and when you usually leave work. Once you've done all that, you can opt to have a custom weather forecast texted or emailed to you in the morning when you wake up. Huang and a contract writer come up with the copy the night before and like clockwork, Huang gets up at 5:30 to make sure the information is still accurate for the day before pulling the trigger. Take, for example, a few texts I've received in recent weeks:

  • Partly cloudy skies & a clear evening. Temps hitting the low 80s. You guys, could this change our attitudes about Mondays?
  • Prime June day in the low 80s. Hot enough, but comfortable. June, you're much chiller than other months. Looking at you, July.
  • It'd be all fire hydrant sprinklers if we were in old school NYC. Similar to yesterday with temps in the high 80s. Get tan or get to shade.

Now, if you take the train or drive, the web version of your forecast (below) would tell you of any delays on your particular line or whether or not you had to move your car to the other side of the street. And if I had a dog, it'd even tell me the best time take the pooch out.

Before even writing a line of code, Huang tells me he'd wake up at 5:30 every morning and email 20 people from the Betaworks office to see what information they actually wanted about the weather. He began working on Poncho in February, pulling openly available data from the MTA, New York City Department of Transportation, Weather Underground and Forecast.io, the makers of the Dark Sky iOS app. From those four sources, Poncho is able to tell you exactly what you need to know to go about your day?in plain English.

"My job at Poncho is to explain all that data to people. I don't want to just give you a number," Huang says. "I'll tell you what's actionable."

And an app is in the works, too, though Huang is still figuring out what additional functionality it will give users. For now, he wants Poncho to be a passive experience?something that, in his words, "you'd never have to open." By tracking your habits based on location, Huang thinks he can anticipate your behavior in the future?information that will help him better understand how to deliver the forecast to you.

In recent weeks, Poncho has rolled out a couple of new features, including an animated GIF that refreshes to reflect the day's weather on the site. And in the coming weeks, users will be able to opt into an afternoon edition that pushes an alert to you before you leave work with traffic and weather updates, along with a forecast for the next day.

I've been using Poncho for the better part of the last two months and it hasn't steered me wrong. I've been caught out in the rain once due to my own idiocy and I've only launched the other weather apps I have to check the extended forecast. Checking the weather just isn't something I need to do anymore.

Poncho is limited to New York City for now, and Huang isn't in a rush to expand just yet, though he is looking at San Francisco or Chicago down the road. When I asked when he would be, he simply said, "Not until it's the best experience that it can be." [Poncho]

Two dead in Egypt clashes as Mursi readies speech

CAIRO (Reuters) - Two people were killed and dozens injured in street fighting on Wednesday north of Cairo between supporters and opponents of Egypt's Islamist president, hours before Mohamed Mursi was to address the nation.

With Egypt gripped by fears of a showdown between Islamists and their opponents, security sources said 90 people wounded in the city of Mansoura after hundreds of men were involved in rock-throwing street skirmishes. Witnesses heard gunfire and state television showed a man in hospital with birdshot wounds.

Similar outbursts of violence, often prompted by one side or the other staging rallies, have hit towns across the country in recent days. At least two men died last weekend. The opposition plans mass protests this weekend, calling for Mursi to resign.

He shows no sign of doing that and is expected to blame the deadlock that has aggravated an economic crisis on resistance from those loyal to his ousted predecessor Hosni Mubarak.

The army has warned politicians it could effectively take charge again if they fail to reconcile. Some in the anti-Mursi camp might welcome that, but Islamists say they would fight any "coup" against Egypt's first freely elected leader.

Fears of a violent stand-off in the streets between Mursi's Islamist supporters and a broad coalition of the disaffected have led people to stock up on food. Long lines of cars outside fuel stations have snarled roads in Cairo and other cities.

Mursi, who marks his first year in office on Sunday, has given little hint of the contents of a speech due to start after 9:30 p.m. (1930 GMT) at a Cairo hall before an invited audience. Aides have indicated he will defend familiar positions, though there has been speculation he might also reshuffle his cabinet.

Some observers fear Egypt may be about to erupt again, two years after the revolution that toppled Mubarak. Politics are polarized between Mursi's disciplined Muslim Brotherhood and disparate opponents who have lost a series of elections.

The deadlock has contributed to a deepening economic crisis and the government is running out of cash.

Liberal critics worry about Islamist rule - a coalition of local human rights groups accused Mursi's Muslim Brotherhood on Wednesday of crimes rivaling Mubarak's and of setting up a "religious, totalitarian state". But many Egyptians are simply frustrated by falling living standards and fear chaos.

After the violence in Mansoura, state television put the number of injured at 160 and said rival factions were on the streets of other nearby towns in the Nile Delta as night fell. Crowds were also gathering in Cairo, in separate locations.

Lining up at a bank machine in downtown Cairo, IT trainer Amgad al-Fishawi, 40, said he feared cash could be hard to find in the coming days and echoed the resignation felt by many at the deadlock: "Mursi won't promise too much," he said. "Nobody's paying attention. The people don't expect anything from him."

ARMY ALERT

The army is held in high regard by Egyptians, especially since it pushed aside Mubarak following the 2011 uprising. Its chief issued a warning on Sunday, urging compromise while also defending the legitimacy of Mursi's election.

One senior Western diplomat in Cairo said the army might try to impose a solution, especially if the political deadlock turns violent: "The margin for a political solution is definitely very narrow," he said. "If (violence) crosses a certain threshold, the role of the army might become by default more proactive."

Islamists, oppressed for decades, fear a return of military rule and hardliners warn of a fight if the generals intervene. They accuse Mubarak-era institutions, including courts, state media, police and civil service, of working to undermine Mursi.

An officer in one of Egypt's internal security agencies told Reuters this week that the country needed to be "cleansed" of the Islamists who he described as terrorists.

The army, still heavily funded by Washington as it was under Mubarak, and Western governments have been urging Mursi to bridge differences with his non-Islamist opponents. He says he has tried. They say he and his Muslim Brotherhood, along with harder line allies, are trying to monopolies the state.

Mursi says a petition demanding he quit - which liberal organizers say has 15 million signatures - is undemocratic. In that, he has support from Islamists, who have staged shows of strength in recent days and plan a major Cairo rally on Friday.

Nationwide opposition rallies are due to start on Sunday but could begin earlier.

LOW EXPECTATIONS

"This demonstration is spontaneous and comes from the Egyptian people. We hope that it will bring the government ultimately to a place where the reforms are effected and choices that need to be made about the economy are implemented," U.S. Secretary of State John Kerry said on Tuesday in Saudi Arabia.

"We will obviously hope that it will not produce violence and be a moment of catalyzing positive change for Egypt itself."

The opposition has low expectations of the speech which Mursi appears to be planning to make before a partisan crowd.

After dark, thousands gathered on Cairo's Tahrir Square, cradle of the 2011 uprising, and in the centre of the second city Alexandria to listen to what the president says.

Liberal coalition spokesman Khaled Dawoud likened Mursi's address to increasingly desperate speeches made by Mubarak during the revolt. He added: "It's too late for any possible measures, short of early elections, to stop the demonstrations."

At the International Crisis Group, Egypt analyst Yasser El-Shimy said he still doubted the army wanted, or would try, to take control and was more likely to push parties to compromise.

"What is going to be a game changer," he said, "is whether the violence is so massive or out of control that the government is unable to function - which might be a scenario that some are hoping for in order to prompt the military to intervene."

Couple lets coffee drinkers choose baby name

WEST HAVEN, Conn. (AP) ? A Connecticut couple has named its baby with help from customers at a Starbucks coffee shop.

Twenty-five-year-old Jennifer James and 24-year-old Mark Dixon of West Haven told the New Haven Register (http://bit.ly/1adT5d6 ) they had been struggling between two names for the boy they are expecting in September, so they decided to put it to a vote.

They placed signs at the Starbucks on the New Haven Green, where they are regulars, asking people to vote for either the name Jackson or Logan.

The couple said it got the idea for the voting based on a system used by that Starbucks location, where customers cast votes for the store's employee of the month.

"We saw that and thought we might as well see how it works," Dixon said.

They received about 1,800 votes in the coffee cup serving as a ballot box. The couple said voters did not limit themselves to the two choices they were given.

"We've gotten Obama, Jebediah, Lincoln. Someone put (a) write-in, Webster," James said.

James said that when she realized Dixon would sound similar to Jackson, she began pulling for the name Logan.

"I don't know why I didn't realize the 'Jackson Dixon' thing, but I think once I realized that, he was going to be Logan no matter what," she said.

The name Logan also was favored by the customers, but ultimately both names won.

The couple said it will name the baby Logan Jackson Dixon.

Opportunities In Home Healthcare - Seeking Alpha

The home healthcare industry in the U.S. is experiencing a boom with a growing demand for services. Baby boomers, those born between 1946 and 1964, are now moving into retirement age. Because of this, a sharp increase in the need for healthcare and social assistance services is expected to follow.

The primary reason for this growth is due to the increase in the number of senior citizens. According to Census, the 65-year old and older population share of total population is around 13 percent is 2010. This group's population share is projected to increase in 2020 to 16 percent and in 2030 to 19.3 percent.

Home healthcare services are classified as a sub-sector of ambulatory service industry. These service organizations (some of them are Medicare-certified) include home healthcare agencies, home care aide organizations and hospices.

Home healthcare is cost effective for people recovering from a hospital stay, functional or cognitive disability, or who are unable to take care of themselves. It also strengthens and complements the care given by family and friends, while maintaining the independence and dignity of the care receiver.

This article highlights four publicly traded companies that specialize in home healthcare. Each company is a small cap, which opens up the possibility for consolidation.

Medicare home healthcare consists of skilled nursing, physical therapy, occupational therapy, speech therapy, aide services, and medical social work provided to beneficiaries in their homes. To be eligible for Medicare's home health benefit, beneficiaries must need part-time (fewer than eight hours per day) or intermittent skilled care to treat their illnesses or injuries and must be unable to leave their homes without considerable effort. Medicare requires that a physician certify a patient's eligibility for home healthcare and that a patient receiving service be under the care of the physician.

The home health benefit has changed substantially since the 1980s. Implementation of the inpatient prospective payment system (PPS) in 1983 led to increased use of home health services as hospital length of stay decreased. Medicare tightened coverage of some services, but the courts overturned these curbs in 1988. After this change, the number of agencies, users, and services expanded rapidly in the early 1990s. Between 1990 and 1995, the number of annual users increased by 75 percent and the number of visits more than tripled to about 250 million a year. Spending increased from $3.7 billion in 1990 to $15.4 billion in 1995.

The trends of the early 1990s prompted increased program integrity actions, refinements to eligibility standards, temporary spending caps through interim payment system and replacement of the cost-based payment system with a PPS in 2000. Since implementation of the PPS, the number of home visit episodes increased from3.9 million in 2001 to 6.8 million in 2010. The number of agencies in 2011 was almost 11,900, about 1,000 more agencies than at the earlier peak of spending in 1997.

The Patient Protection and Affordable Care Act of 2010 includes several reductions intended to bring payments more in line with costs:

  1. 2011 - The standard 60-day episode rate was reduced by 2.5 percent.
  2. 2012 and 2013 - The market basket update was reduced by 1 percent.
  3. 2014-2016 - A phased rebasing was implemented to lower payments to a level to reflect changes in average visits per episode and other factors that may have changed since the rate was originally set.
  4. 2015 and following years - The market basket was reduced by multifactor productivity for each year.

While these reductions will affect home healthcare payments, companies are able to adjust their operations to maintain positive financial performance. The experience of 2003, when Medicare implemented a 5 percent reduction to the home healthcare base rate, is illustrative. All four of our subject companies reported net profits in 2006. While the payment changes in the new law are significant, experience with prior adjustments suggests that some companies will likely be able to offset at least a portion of these reductions.

Addus HomeCare Corporation (ADUS) provides home healthcare to a variety of consumers. The company's payers include federal, state and local governments, commercial insurers and private pay individuals. The company offers services in 19 states to 26,000 consumers. In March 2013, Addus sold its Home Health business to LHC Group.

ADUS has a December fiscal year. In 2012, net income totaled $7.6 million on $244.3 million in revenue. Compared with 2011, sales increased 6.2 percent. The company had a net loss of $2.0 million in 2011. EPS for the first quarter of 2013 was $0.25 on $63.0 million of sales compared to the year-ago EPS of $0.16 on $58.9 million sales.

Gross margins are holding steady in the 26 - 27 percent range. Net margins fluctuate dramatically year to year. The company closed FY2012 with a net margin of 3.1 percent and the margin for the trailing twelve months has expanded to 6.5 percent. Operating margins are about 6.5 percent. The company carries on the books about $17.8 million of cash and has no long-term debt.

Almost Family (AFAM) is another small cap with a recent market capitalization of $181 million. Revenues for the twelve months ending March 2013, fell 0.9 percent compared to the year ago period. Quarter-over-quarter revenue fell 3.4 percent. In 1Q13 EPS was $0.35 on $86.9 million in revenues compared to 1Q12 EPS of $0.53 on $90.0 million of revenue. Gross margins are in the 47 - 48 percent range and net margins are about 7 - 8 percent. AFAM has on $0.5 million in long term debt and $34.6 million in cash.

Almost Family provides services in Florida, Kentucky, New Jersey, Connecticut, Ohio, Massachusetts, Missouri, Alabama, Illinois, Pennsylvania and Indiana.

Amedisys (AMED) delivers the typical range of home health services through 440 Medicare-certified home healthcare centers and 87 Medicare-certified hospice care centers. It operates in 41 states, the District of Columbia and Puerto Rico.

The company experienced a decline in revenues of 1.6 percent during the twelve month period ending March 2013. This revenue decline accompanied a 6.9 percent decline in gross income. However, net income increased by 78.0 percent.

Quarter-over-quarter revenue declined to $339.2 million from $370.8 million and EPS dropped to $0.09 from $0.22. Gross margin remained steady at about 43 percent but net margin was (5.9) percent. The company reported a net loss for 2012 and 2011.

AMED has long-term debt of $43.0 million and cash of just $7.0 million. Cash from operations is negative though free cash flow is positive.

Our final company is also the largest by revenue. Gentiva Health Services (GTIV) had 2012 revenues of $1,712.8 million and 2012 net income of 426.8 million. FY2012 EPS is $0.88. 1Q13 saw a EPS at ($6.73) on $415.6 million revenue compared to an EPS of $0.16 on revenue of $435.7 million. Gentiva has a fairly high gross margin of about 47 percent but has been struggling to make a profit since 2010. The company reports cash of $159.6 million and long term debt of $903.9 million.

The table shown above reflects the quantitative factors I consider most critical for evaluating valuation and profitability. I always pair an earnings based metric with cash based metric when measuring profitability and valuation.

From the outset, I consider AMED and GTIV poor choices due to their lack of earnings before interest, taxes and non-cash expenses. Their free cash yield is adequate and free cash to operating income, in both cases, is strong. AMED's cash return on invested capital is low relative to the alternatives. Finally, GTIV has insufficient free cash to safely cover its long-term debt.

AFAM is selling at a low valuation of 5.25X EV/EBITDA and has an acceptable free cash yield. Free cash to operating income indicates that it is converting a significant portion of its operating income to free cash. The returns on invested capital based on EBITDA less capital expenditures and free cash to invested capital are less than I require from an investment.

The smallest of the subject companies, ADUS, offers the best combination of valuation and profitability. It passes all of our tests. The market seems to agree as the company is trading near its 52-week high. ADUS is not a widely followed company; Thomson Reuters reports just three EPS estimates for 2013.

Capt. Jeff Hink says 38-year-old Bobby Darren Reynolds of Gardena was killed Friday night outside the building while visiting family.

Hink said Reynolds was shot multiple times at close range and appeared to be specifically targeted.

Witnesses reported seeing two men fleeing in a Chrysler 300 sedan which was found abandoned blocks away from the shooting scene.

Investigators identified the car's owner, 27-year-old Erick Julian Ortega, as a person of interest in the case and want to talk to him. They said Ortega has a criminal record with prior arrests for robbery and drug offenses.

Ecuador confirms Snowden seeking asylum there

HANOI, Vietnam (AP) ? Ecuador's foreign minister said Monday his country will act not on its interests but on its principles as it considers an asylum request from National Security Agency leaker Edward Snowden, wanted for revealing classified U.S. secrets.

Speaking to reporters in Hanoi, Foreign Minister Ricardo Patino said he could not comment on Snowden's location after the U.S. fugitive did not board a flight from Moscow to Cuba on which he was booked.

"I cannot give information with respect to that ... we cannot offer specific information about the specific situation of Mr. Snowden at this moment," he said.

Patino did not say how long it would take Ecuador to decide on Snowden's asylum request, which he said "has to do with freedom of expression and with the security of citizens around the world."

Snowden had been in hiding in Hong Kong for several weeks after revealing the spy programs. He flew to Moscow on Sunday and was booked on an Aeroflot flight to Cuba on Monday, but an airline representative said he didn't board the plane and AP reporters on the flight couldn't see him.

Patino said Ecuador was in touch with the highest authorities of Russia about the case.

"The government of Ecuador has maintained a respectful diplomatic contact with the government of Russia and has informed it that Ecuador is considering the petition for asylum on the part of Mr. Snowden," he said.

Patino read a letter from Snowden to Ecuador's president in which he asked for asylum "due to the risk of persecution by the government of the United States and its agents."

Snowden said in the letter that he revealed the information about the highly classified spy programs because the U.S. "is intercepting the majority of communications of the world."

"I have been accused of being a traitor" and "there have been calls for me to be executed or imprisoned," the letter said. He said it was unlikely that he could receive a fair trial.

Patino said Ecuador would not base its asylum decision on its potential to damage the country's relationship with the United States.

"There are some governments that act more upon their own interests, but we do not," Patino said. "We act upon our principles."

He added, "We take care of the human rights of the people."

Anti-secrecy group WikiLeaks earlier said Snowden was bound for Ecuador "via a safe route for the purposes of asylum, and is being escorted by diplomats and legal advisers from WikiLeaks." The organization's founder, Julian Assange, was granted asylum by Ecuador last year and has been staying at the country's embassy in the United Kingdom to avoid extradition to Sweden to face questioning about sex crime allegations.

Disney renames Mouseketeer stage for Funicello

BURBANK, Calif. (AP) ? The stage at Walt Disney Studios where "The Mickey Mouse Club" was filmed is now officially the Annette Funicello Stage.

Disney chief Bob Iger led a ceremony Monday dedicating the soundstage to Funicello, the Mouseketeer-turned-movie star who died in April at age 70.

Iger confessed to having a crush on Funicello when he was growing up, as many who watched the perky brunette on TV did.

Former Mouseketeers, Funicello's family and colleagues and Mickey Mouse himself also participated in Monday's dedication. Frankie Avalon, Richard Sherman and Leonard Maltin were among those honoring the late actress.

Julie Andrews is the only other entertainer to have a namesake stage at Disney studios.

Halloween board games can be used at home or school and they provide a great way to occupy kids in the lead up to Halloween. These games can be used to settle down excited kids and are also ideal as a reward for kids who finish their work early in the classroom or for kids who deserve a reward at home. But this is not their only use. Halloween board games also make a wonderful way for the family to spend time together.

There are commercial games available but it is much more fun and also much cheaper to make your own. Once you have made these Halloween games, you then have something that can be used year after year.

To create your own Halloween board games, you just need some stock card and some markers. Stickers and glitter can also be used to dress up the game. You might like to choose a theme for the game like vampires or ghosts or you might like to make it about Halloween in general.

The most common board game is the track board game and this is the easiest type to make. Just draw a track around the board or from the top to the bottom of the board. The track might go from a Haunted House ? the start ? to your house ? the end. Along the track you can have reward spaces and hazard spaces.

The reward spaces might have something like, ?Have another turn.? The hazard spaces might say something like, ?Go back 3 spaces.? ?There can also be Trick or Treat spaces on the board. When someone lands on a Treat space, they can be rewarded by being given a small treat like a candy. When they land on the Trick space, they can pick up a card which will have a trick on it that they have to do. It might be something like, ?Howl like a werewolf.? ?
Your Halloween board game can be decorated with pictures, sticks, glitter, puff paint and anything else that you like.

Once is it ready,you just take turns to throw the dice and move around the board.

A different way to create a Halloween board game is to make a ?Snakes and Ladders? style game. Instead of using snakes and ladders though, you could use witch?s brooms as ladders and black cats with long tails as the snakes. The game can played the same way as the traditional ?Snakes and Ladders? game.

Halloween board games are an ideal game for family fun or classroom fun. If you choose to make your own board this makes it even more fun. Let the kids use their imaginations and see what they come up with. They?ll have fun making the game and they?ll be so proud of what they have made that they won?t want to stop playing it.

$11.5M Picasso seized by US authorities for Italy

NEW YORK (AP) ? A 1909 Pablo Picasso painting titled "Compotier et tasse," or "Fruit bowl and cup," with an estimated worth of $11.5 million will be held by U.S. authorities for the Italian government pending the outcome of criminal proceedings against its owner in Italy, according to the terms of a judge's order signed Monday.

Justice Department authorities assumed control of the painting after U.S. District Judge Victor Marrero signed the order following a formal request by the government of Italy.

U.S. Immigration and Customs Enforcement in Washington said in a news release that Italian authorities requested the seizure after the painting's owner was charged with embezzlement and fraudulent bankruptcy offenses in Italy. The charges allege that the painting's owner caused the city of Naples to lose $44 million through a variety of schemes that avoided taxes, including fraudulent service contracts, forged accounting records and inflated operational expenses.

Homeland Security agents seized the painting May 21, when it was being offered for private sale for $11.5 million.

"We are very pleased that our investigation has led to the recovery of this painting that is so significant to the Italian people," ICE Director John Morton said.

Judge: No audio testimony in Zimmerman trial

ORLANDO, Florida (Reuters) - Two voice identification experts who suggested that unarmed black teenager Trayvon Martin screamed for help before he was shot and killed by George Zimmerman will not be allowed to testify at his murder trial, the judge in the case has ruled.

The ruling by Judge Debra Nelson was released on Saturday, marking the last major hurdle before opening statements in the high-profile case begin on Monday in Seminole County courthouse in Sanford, Florida.

Prosecutors had sought to call audio experts to testify about a 911 emergency call in which screams for help can be heard in the background during an altercation between Zimmerman and Martin before the shooting.

The screams could be pivotal evidence and help identify who was the aggressor on the night of the February 2012 killing. Zimmerman's family and supporters claim the voice was his, while Martin's parents insist the voice belonged to their son.

Last year, an FBI expert said a voice analysis of the call was inconclusive.

David Weinstein, a Miami lawyer and former prosecutor, called the ruling a victory for Zimmerman's defense team.

"Now there won't be a witness who can 'identify' the voice with certainty as a particular person," he said. "Each side can argue who they believe the voice belongs to and the jurors will have to decide who they hear."

Prosecutors say Zimmerman followed and confronted Martin despite a police dispatcher telling him not to pursue the 17-year-old. Zimmerman, 29, has said the two fought and that he shot Martin because he feared for his life.

An all-female jury will decide whether Zimmerman is guilty of second-degree murder, a charge that carries a potential life sentence. Zimmerman has pleaded not guilty.

Nelson said in her 12-page order that the decision does not prevent either side from playing the 911 tape and presenting witnesses familiar with Zimmerman's and Martin's voices from stating their opinions.

Lead defense attorney Mark O'Mara has called the recording "the most significant piece of evidence in the case."

Two state experts, in what they qualify as tentative or probable findings because of the poor quality of the recording, have said that the chilling screams heard in the background came from Martin.

Lawyers for Zimmerman, a former neighborhood watch volunteer, sought to block the testimony on grounds that the methods used by the state's voice recognition experts were based on questionable science.

Audio experts who testified for the defense in a lengthy pre-trial hearing argued that voice recognition techniques cannot identify an individual from screams made under extreme duress.

On Friday, the judge also dismissed a defense motion to bar certain words and phrases from the prosecution's opening statement.

She ruled prosecutors could allege that Zimmerman, who is Hispanic, "profiled" Martin but ordered them not to use the term "racial profiling."

Opposition activist shot dead in Albania on election day

TIRANA (Reuters) - An Albanian opposition activist was killed and a ruling party parliamentary candidate wounded in a shootout on Sunday in the northwest of the country shortly after voting began in a tense election, police said.

Police named the dead man as 53-year-old Gjon Pjeter Gjoni, an activist of the opposition Socialist Party in the region of Lac. Mhill Fufi, a parliamentary candidate from the ruling Democratic Party of Prime Minister Sali Berisha, was wounded, as was another man in the incident outside a polling station

Socialist Party leader Edi Rama, who is trying to unseat Berisha, canceled his own scheduled vote to go to Lac.

Light up: Casper repeals smoking ban for bars

CHEYENNE, Wyo. (AP) ? Not all of America is moving toward banning smoking indoors and out. Months after prohibiting it, Casper, Wyo., is now telling smokers that it's OK to light up in some public spaces.

The City Council voted 5-4 Tuesday to repeal part of an indoor smoking ban in effect since September. The vote lifted the ban for bars, but kept it in place for restaurants.

Bar owners had complained they were losing business to competitors in two nearby towns that allowed smoking. Repeal supporters also said it was an example of government getting too involved in civic life, citing New York City Mayor Michael Bloomberg's efforts to ban super-sized soft drinks.

"Just like what Mayor Bloomberg has done, or tried to do, with sugared drinks. It's just not going to stop unless somebody stands up and says, 'Wait a minute,' and 'Let's use some common sense here,'" said Pat Sweeney, owner of a hotel with a bar now smoke-free because of the ban.

There have been efforts in recent years to overturn smoking bans.

In North Carolina, a legislative committee last month approved a bill that would have prevented local communities and community colleges from enacting smoking bans stricter than in state law. Health advocates said the measure would have overturned local bans on smoking in certain outdoor areas.

The measure didn't meet a key deadline and failed to advance.

Last year, voters in Springfield, Mo., had a chance to repeal a year-old smoking ban enacted there. They voted against repeal by an almost 2-to-1 margin.

Casper is a rare example of a ban ? albeit a partial one ? being repealed. A new crop of City Council members elected last fall made the difference. Three of the four new members voted for the changes.

"The more liberal side of our populace is trying to get too much into touchy-feely and government control of everything," said one of the new councilmen, Steve Cathey.

Proponents of amending the ordinance said the changes apply to relatively few businesses. They include only about half a dozen bars. Most of Casper's dozens of other bars are within restaurants or already prohibited smoking before the ban took effect.

Smoking now will also be allowed in nursing homes (one nursing home in town had a designated smoking area that was closed) and areas of industrial shops and auto service centers not open to the public.

The changes take effect June 28 but could be short-lived if opponents gather 2,465 valid signatures to put the matter before voters.

"It's unfortunate because a new council came in and they listened to a small group of people and didn't listen to the majority of the people," said Pam Evert, a local anti-smoking organizer.

People on both sides of the issue said they expect a successful petition drive and a hard-fought campaign to win over their fellow citizens.

"They're trying to socially engineer us," said Sweeney. "And a lot of us have had enough."
